Cookies Management Policy

Article 1– Definitions

Cookies : The term “cookie” for the purposes of this management policy has the meaning given in recital 66 in Directive 2009/136/EC amending Directive 2002/22/EC on universal service and users’ rights relating to electronic communications networks and services, Directive 2002/58/EC concerning the processing of personal data and the protection of privacy in the electronic communications sector and Regulation (EC) No 2006/2004 on cooperation between national authorities responsible for the enforcement of consumer protection laws, (O.J., L 337, 18 December 2009). These are examples of tracers deposited and/or read during the consultation of an Internet site allowing the user’s browsing preferences to be retained.

Applicable law: Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, Law of 30 July 2018 on the protection of natural persons with regard to the processing of their personal data and the Electronic Communications Act of 13 June 2005 and any measure implementing these provisions or any other legally binding text replacing these legal instruments.

Computer: a computer with a workstation, a laptop, a tablet, a two-in-one computer, a smartphone and any other computer device with physical storage capacity.

Company: the person responsible for processing the data collected during consultation of the Website, namely the limited liability company under Belgian law “LAW IN NOVATION”, with its registered office at Avenue Louise 480 box 11 at 1050 Brussels, registered with the Crossroads Bank for Enterprises under number 0632.472.959

The purpose of this policy is to inform users of the Website of how Cookies are used by the Company.

Article 3 - Purpose of depositing Cookies on the Computer

The Website uses Cookies to make browsing more useful and reliable. Some of these Cookies are essential to the operation of the Website, others help to improve the user experience.

Article 4 - Types of Cookies that can be deposited when using the Website

The Website uses different types of Cookies:

  • Essential or technical Cookies: these are essential Cookies for the operation of the Website, allowing good communication and intended to facilitate browsing ;
  • Statistical or analytical Cookies: these Cookies make it possible to recognise and count the number of visitors and to see their browsing behaviour when they visit the Website. This makes it possible to improve the user’s navigation and makes it easier for him to find what he is looking for;
  • Functional Cookies: These Cookies enable specific features on the Website to be activated to improve the user experience and user friendliness, in particular by remembering the user’s choice of preferences (e.g. language);
  • Performance Cookies: These Cookies collect information about how visitors use the Website. They are used to evaluate and improve the content and performance of the Website (e.g. by counting the number of visitors, identifying the most popular pages or clicks), and to better match commercial proposals to the user’s personal preferences;
  • Advertising or commercial cookies: these are files intended to collect data relating to the profile of visitors and may be installed or read by third parties with whom the Company collaborates in order to measure the effectiveness of an advertisement or web page and to better adapt it to the user’s interests;
  • Tracking Cookies: the Website uses Tracking Cookies via Google Analytics, in order to help the Company to measure the ways in which users interact with the content of the Website, and which generates visit statistics in a strictly anonymous manner. These statistics are used to continually improve the Website and to provide the user with relevant content.

The Company uses Google Analytics to get an overview of the traffic on the Website, the origin of this traffic and the pages visited. This means that Google acts as a subcontractor.

The information collected by Google Analytics is generated as anonymously as possible. For example, it is not possible to identify the people who visit the Website.

The Company is also likely to use Cookies and tags to collect information on users’ surfing habits on the various websites and applications belonging to its advertising network. A tag is an invisible image file that follows the user’s navigation on one or more websites and/or applications. In addition, other commercial Cookies may be installed by advertisers when broadcasting their advertisement.

Commercial Cookies do not contain any personal data. The information collected using Commercial Cookies and tags is used to measure the effectiveness of advertising and to better personalise advertising on the Website and on other websites belonging to the advertising network or for which the Company provides advertising services.

Article 5 - Time limit for storing Cookies

The storage period of Cookies varies according to their type: Essential Cookies are generally stored until the browser is closed, while Functional Cookies remain valid for 1 year and Performance Cookies for 4 years.

Article 6 - Links with third parties

The Company authorises public search engines to visit the Website via ‘spiders’ for the sole purpose of making the access and content of the Website accessible via their search engines, without the Company granting the right to archive the Website. The Company reserves the right to withdraw the authorisation as set out in this article at any time.

In order to make offers likely to be of interest to the user, the Company may enter into agreements with Internet advertising agencies. They have received authorisation from the data controller to place advertisements on the Website. When the user visits the Website, the advertising agencies may also collect information.

Article 7 - Management of Cookies by the user

Most browsers are configured to automatically accept Cookies, but all allow you to customise the settings according to your preferences.

If the user does not want the Website to place Cookies on their computer / mobile device, they can easily manage or delete them by changing their browser settings. The user can also set their browser to send a notice when they receive a cookie and thus decide whether or not to accept it.

Article 8 - Applicable law and jurisdiction

This policy is governed exclusively by Belgian law.

Any dispute relating to the interpretation or execution of this policy shall fall within the exclusive jurisdiction of the courts of the judicial district of Brussels.

Article 9 - Miscellaneous provisions

The Company reserves the right to amend the provisions of this Policy at any time in accordance with changes in Applicable Law. Amendments will be published with a warning as to their coming into force.
